Terms and Conditions for ABZ Driving School

1. About Us

These Terms and Conditions form the contract between ABZ Driving School (“the School,” “we,” “us,” “our”) and you (“the Pupil,” “the Student,” “you”). By booking and attending a lesson, you agree to be bound by these terms.

2. Driving Instructor Standards

Our instructors are Approved Driving Instructors (ADIs) or Potential Driving Instructors (PDIs) registered with the Driver and Vehicle Standards Agency (DVSA). We adhere to the voluntary DVSA Code of Practice, ensuring professional, ethical, and courteous service at all times. Our tuition vehicles are fully insured, well-maintained, and fitted with dual controls for your safety.

Code of Conduct: ABZ Driving School operates a zero-tolerance policy towards abusive, threatening, or violent behaviour. Any such conduct will result in the immediate termination of the lesson or future services, and the full lesson fee will be forfeited.

3. Eligibility and Your Obligations

  • Licence and Age: You must be at least 17 years old and hold a valid UK provisional driving licence. You must present this licence (physical or digital) for verification before your first lesson.
  • Fitness to Drive: You must meet the DVSA eyesight standards and inform your instructor of any medical conditions or medications that may affect your driving. You must not attend a lesson under the influence of alcohol or drugs. The instructor reserves the right to cancel the lesson immediately if you are deemed unfit, and the full lesson fee will be charged.
  • Dress and Conduct: Appropriate clothing and footwear (e.g., flat shoes, no flip-flops) must be worn to ensure safe control of the vehicle.

4. Bookings, Payments, and Cancellations

4.1 Payments

  • All lesson fees are due in advance or at the start of each lesson unless a block booking has been arranged. We accept [specify methods, e.g., bank transfer, cash, card].
  • Prepaid block bookings and vouchers are valid for 6 months from the date of purchase, unless a longer period is agreed upon in writing. Unused lessons after this expiry date are non-refundable.

4.2 Your Cancellations

  • 48-Hour Rule: A minimum of 48 hours’ notice is required to cancel or reschedule a lesson without charge. Notice must be given directly to your instructor via phone or [insert your preferred App/System].
  • Late Cancellations: Cancellations made with less than 48 hours’ notice, or failure to attend a lesson (no-show), will incur the full lesson fee.

4.3 Our Cancellations

  • We reserve the right to postpone lessons due to adverse weather, mechanical breakdown, or instructor illness. We will make every reasonable effort to reschedule the lesson promptly. We are not liable for any indirect losses arising from such cancellations.

4.4 Right to Cancel (Cooling-Off Period)

  • Under the Consumer Contracts Regulations 2013, you have 14 days from the date of booking to cancel a block booking or course purchased online or by phone. If you request tuition to begin within this 14-day period and subsequently cancel, you will be charged for lessons already delivered at the standard hourly rate plus any reasonable administrative costs.

5. Refunds Policy

Your statutory rights under the Consumer Rights Act 2015 remain unaffected.

  • Statutory Cancellation: A full refund for unused lessons within the 14-day cooling-off period (see 4.4).
  • Medical Conditions: Pro-rata refunds or extensions for unused prepaid hours may be granted at management’s discretion upon receipt of a valid medical certificate confirming you are unfit to drive.
  • School Default: If we cannot provide the agreed tuition and cannot find a suitable replacement within 28 days, a pro-rata refund for unused hours will be issued.
  • Non-Refundable Items: Refunds are not provided for lessons already taken, gift vouchers beyond their expiry date, or block bookings that have expired without a prior agreed extension.

6. Lesson Punctuality

  • Pupil Late Arrival: Instructors will wait for a maximum of 15 minutes. If you arrive late, the lesson will still finish at the scheduled time. If you do not arrive or make contact within this 15-minute window, the lesson will be treated as a no-show and forfeited.
  • Instructor Delay: If your instructor is running late, they will contact you directly. Any lost time will be added to the current lesson or a future appointment.

7. Driving Tests

  • Booking: The decision to book a driving test should be made jointly between you and your instructor. You must inform us immediately of your test date and time to secure the use of the school vehicle.
  • Vehicle Use: We reserve the right to withhold the school vehicle for a test if, in the instructor’s professional judgment, your driving is unsafe or not yet at the DVSA test standard. You will be provided with a clear explanation of the reasons.
  • Test Day Fees: A standard “test day” fee applies to cover the pre-test lesson, vehicle use for the test, and the instructor’s time to accompany you to the test centre. This fee is [specify amount, e.g., £100–£150].
  • DVSA Cancellations: We are not liable for fees lost due to DVSA test cancellations or you failing to give the statutory 10 working days’ notice to the DVSA to change your test date.

8. Liability

  • Vehicle Insurance: Our tuition vehicles carry comprehensive motor insurance for driving tuition and tests. Details are available on request. Claims for personal injury or damage occurring during a lesson should be directed to the insurer.
  • Personal Belongings: We do not accept responsibility for loss or damage to personal property left in the vehicle.
  • Limitation of Liability: To the fullest extent permitted by law, our liability for any claim will not exceed the total fees you have paid for the specific service giving rise to the claim in the 12 months prior to the incident.

9. Data Protection (UK GDPR)

We collect and process your name, contact details, driving licence status, and lesson history solely for the purpose of providing driving tuition. Your data is stored securely and will never be sold. You have the right to access, correct, or request deletion of your data by contacting us at [Insert Email Address].

10. Governing Law

These Terms and Conditions are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the English courts.
